COMPETITION RULES

Competition – BEOSOUND A5 NORDIC WEAVE – December 2024

ARTICLE 1: ORGANISING COMPANY

Bang & Olufsen France, registered in the Nanterre Trade and Companies Register under number 485 333 181 and domiciled at 8 avenue Hoche 75008 Paris (hereinafter referred to as the ‘Organising Company’) is organising a competition with no obligation to purchase, valid from 07/11/2024 at 10:00 a.m. to 26/12/2024 at 00:01 a.m., entitled ‘Competition - Christmas 2024’ (hereinafter referred to as the ‘ Competition ’) and accessible exclusively via the Bang & Olufsen link.

ARTICLE 2: PARTICIPANTS

This Competition is only open to natural persons of legal age residing in mainland France (including Corsica) and taking part in the B&O campaign (hereinafter referred to as the ‘ Participant ’).

Staff of the organising Company who have been directly involved in the organisation of the Contest and who have information enabling them to partially or totally avoid the randomness governing this Contest, as well as members of their respective families in a direct line (including cohabitants) living under the same roof, may not take part in the Contest.

Participation in the Contest is limited to one entry per person.

ARTICLE 3: COMMITMENTS OF PARTICIPANTS

In order to take part in the Contest, it is the Participant's responsibility to ensure that their details are entered correctly and, in particular, that their e-mail address is working properly. If, after the winner's file has been compiled, it appears that there is any doubt as to the accuracy of the details provided, Participants authorise the Organising Company to carry out any and all checks concerning these details, without however being obliged to carry out a systematic check of all entries received, but it may limit this check to potential winners.

Participants who attempt to participate by means such as automatic participation systems, programmes developed for automated participation (automated voting in particular), use of information, email, customer numbers other than those corresponding to their identity and address and more generally by any means that do not comply with respect for equal opportunities between Participants during the Contest will be automatically eliminated.

In particular, those who, by any means whatsoever, attempt to modify the proposed Contest mechanisms, in particular in order to modify the results, will be excluded. The same physical person may not play with several electronic addresses, nor play from a player account opened for the benefit of a person other than him/herself.

Any registration with inaccurate or incomplete contact details or any attempt at fraud will result in the invalidity of participation in the Contest and will not entitle the Participant to the prize, which will remain the property of the Organising Company.

In general, any abusive behaviour resulting in a distortion of the very principle of the Contest, any attempt at fraud or cheating on the part of a Participant will result in the invalidity of all his/her registration forms.

Only entries on the site will be taken into account. No entries by telephone or post will be taken into account.

ARTICLE 4: TERMS AND CONDITIONS OF PARTICIPATION

Like any commercial lottery, this Contest is governed by chance and each Participant must respect its spirit and rules.

To take part in the Contest, the Participant must:

- Fill in their details on the page dedicated to this competition and validate their participation.

The Competition consists of taking part in a prize draw.

The Participant who is drawn will win a Beosound A5 Nordic Weave, worth €1399 (as at 15 November 2024).

ARTICLE 5: NAMING THE WINNER

The winner of the Competition will be designated and contacted by email no later than 06/01/2025.

ARTICLE 6: PRIZE

The winner will receive a Beosound A5 Nordic Weave, worth €1,399 (as at 15 November 2024).

The prize offered to the winner may not be exchanged or replaced for another prize, of any value whatsoever, for any reason whatsoever.

It is specified that the organising Company does not offer the winner any commercial guarantee on the prize awarded and won by the winner.

Finally, the organising Company reserves the right to replace the prize with another of equivalent value, in the event of difficulties beyond its control in delivering the advertised prize.

ARTICLE 7: DELIVERY OF THE PRIZE

The winner will be contacted by email no later than 06/01/2025 and will receive his/her prize by post or at the Bang & Olufsen boutique at 9 Rue des Archives, 75004 Paris.

The prize may not be contested in any way whatsoever by the Winner. It is strictly personal and nominative, such that it may not be transferred or sold to any third party whatsoever; under no circumstances may it be exchanged or exchanged for its full or partial value, in kind or in cash, by the Organising Company. However, in the event of force majeure, the Organising Company reserves the right to replace this prize with a prize of a different or equivalent nature.

ARTICLE 8: PERSONAL DATA

The general personal data protection policy available at privacy-policy (bang-olufsen.com) applies.

ARTICLE 9: LIMITATION OF LIABILITY

The Organising Company may not be held liable for any reason beyond its control, particularly in the following cases:

- If the website(s) required for the Competition were temporarily unavailable

- If the Contest could not take place under the conditions foreseen, causing a disruption in the organisation and management of the Contest and leading the organising Company to shorten, extend, postpone, modify or cancel the Contest.

The organising Company further informs that, given the characteristics of the Internet network, such as the free capture of the information disseminated and the difficulty, or even impossibility, of controlling the use that may be made of it by third parties, it cannot be held responsible for any misuse of this information.

The organising Company may not be held liable for the fraudulent use of a Participant's rights to connect or to be awarded a prize, unless it demonstrates the existence of gross negligence.

The Organising Company accepts no liability in the event of malfunction of the Internet network, telephone lines or reception equipment preventing the Contest from running smoothly. In addition, the organising Company may under no circumstances be held liable for problems with the routing or loss of electronic or postal mail.

The organising Company shall not be held liable in the event of any technical failure, anomaly, hardware or software of any kind (virus, bug, etc.) caused to the Participant's system, computer equipment and data stored therein and the consequences that may arise from this for his/her personal, professional or commercial activity.

The organising Company may not be held liable for sending an e-mail or letter, or for sending a prize, to an incorrect address due to the winner's negligence. The Organising Company will not carry out any additional research if the winner remains unavailable and/or unreachable.

Once the prize has been delivered to the winner's address, the prize will be deemed to have been delivered and the winner will assume full responsibility for the prize. In other words, the organising Company, as well as its service providers and partners, may not be held responsible for the loss or theft of gift card prizes once the winners have taken possession of them.

The organising Company shall not incur any liability whatsoever if, in the event of force majeure or events beyond its control (in particular technical problems, etc.) disrupting the organisation and management of the Contest, it is forced to shorten, extend, postpone, modify or cancel the Contest.

Additions, or in the event of force majeure, amendments to these rules may be published during the Competition. They will be considered as amendments to these rules.

ARTICLE 10: RULES

ARTICLE 11: APPLICABLE LAW - CLAIMS

11.1 The law applicable to these rules is French law.

11.2 In order to be taken into account, any disputes relating to the Contest must be submitted to the following address: B&O France 6, avenue Franklin Delano Roosevelt 75008 PARIS

Any claim relating to the prize must be accompanied by the confirmation e-mail stipulating : - the prize won by the Participant ; - his/her contact details (title, surname, first name, postal address, telephone number); - the subject of the claim. Any dispute arising in connection with this Contest may be the subject of an attempt at amicable settlement. Failing agreement, the competent court will be that of the defendant's domicile, unless otherwise provided by law.
